Is the current Whatcom County jail a legal liability?

Recently the ACLU of Washington filed a lawsuit against King County alleging violations regarding access to medical care and court for individuals incarcerated in the King County Correctional Facility. Given Whatcom County Jail’s similar conditions and limitations, it could be the subject of a similar filing.
